The petitioner seeks bail in connection with Garkha P.S. Case No. 104 of 2014 registered under Sections 304-B read with 34 of the Indian Penal Code.
It is contended that the petitioner is the husband of the victim Sunita Devi who had set herself on fire due to some dispute with the petitioner. The moment the petitioner came to know about the incident with the help of villagers, he took the victim to the Sadar Hospital, Chapra for medical aid, but unfortunately, she could not be saved. It is further contended that there is no truth behind the allegation of demand of dowry
Patna High Court Cr.Misc. No.57390 of 2015 (3) dt.05-02-2016 2 / 2 or subjecting the victim to cruelty for non-fulfilment of same. Learned counsel for the State has opposed the application for bail. However, he concedes that during investigation some of the witnesses have supported the defence of petitioner.
Regard being had to the facts and circumstances of the case, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra in connection with Garkha P.S. Case No. 104 of 2014.
