JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 28-10-2021 This petition has been filed for quashing of letter no. 3047 dated 25.09.2020 issued by the Registrar of Aryabhatta Knowledge University, Patna whereby he has refused to counter sign the teaching experience certificate issued by the Netaji Subhash Institute of Technology, Amhara, Bihta, Patna.
It is the petitioner's case that he had been working in Netaji Subhash Institute of Technology, Amhara, Bihta, Patna, from 21.04.2014 to 28.02.2019 as an Assistant Professor. The said institute
Patna High Court CWJC No.8884 of 2020(6) dt.28-10-2021 2/2 is privately managed and is affiliated to Aryabhatta Knowledge University.
On perusal of the impugned letter dated 25.9.2020, it is noticed that the Registrar has clearly recorded that there was no document available with the University in relation to the petitioner's appointment in the Institute and, therefore, the petitioner's request to counter-sign the certificate could not be acceded to. It is submitted on behalf of the petitioner that the petitioner requires the certificate duly counter signed by the Registrar of the University which is a requisite for the purpose of participating in the process of selection for appointment to the post of Assistant Professor in the Universities of Bihar.
In view of the fact noted in impugned letter that the University did not have any record maintained by it to support the petitioner's claim that he was ever appointed or had worked as Assistant Professor in the said institution or any approval was granted by the University of his appointment, no interference is required by this Court in a proceeding under Article 226 of the Constitution.
This application is accordingly dismissed.
