JUSTICE DINESH KUMAR SINGH ORAL ORDER 14-12-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 376/34 of the Indian Penal Code.

The prosecution case is that the informant's marriage was fixed with co-accused Manish Kumar and thereafter coaccused Manish Kumar established forceful relationship with the informant. It is also alleged that on the pretext of marriage gift of Rs. 4, 25, 000/- was also given to the accused persons. It is submitted by learned counsel for the petitioner that in fact the marriage could not be negotiated between the petitioner and the complainant thereafter in order to put pressure to solemnize the marriage, has levelled allegation against him.

Patna High Court Cr.Misc. No.56558 of 2015 (2) dt.14-12-2015 Moreover, the thrust of accusation is against co-accused Manish Kumar.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Patna in connection with Mahila P.S. Case No. 25 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
