JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 22-11-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under Sections 307, 504/34 and other allied sections of Indian Penal Code.
As per prosecution case, this petitioner along with other FIR named accused person assaulted the informant and her husband by means of bamboo.
Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. It is further submitted that there is admitted land dispute between the parties and specific accusation of assault is against co-accused Sanjay Kumar. So far this petitioner is concerned allegation of assault is general and omnibus. Police after investigation submitted final form. Petitioner is Gotini of

Considering the aforesaid facts and circumstances, let the above named petitioner in the event of her arrest/surrender before the court below within a period of thirty days from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-III, Katihar in Falka P.
