The petitioner has prayed for bail in a case registered for the offence punishable under sections 341, 342, 323, 302, 307, 337, 338, 448, 504, 506/34 of the Indian Penal Code.
AS per allegation in the FIR, several accused persons including the petitioner entered into the house of the informant and started to assault by means of lathi, brick and iron rod as a result of which one person, namely, Budhan Choudhary died.
It is submitted by learned counsel for the
Patna High Court CR. MISC. No.43272 of 2023(2) dt.28-07-2023 2/3 petitioner that petitioner has been falsely implicated in this case. There is general and omnibus allegation against the petitioner the petitioner is only alleged to be member of the mob. Similarly situated other accused persons have already been enlarged on bail by another coordinate Bench of this Court vide order dated 24.1.2022 passed in Cr. Misc. No. 30510 of 2021. The petitioner is languishing in judicial custody since 30.04.2022. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. The application for bail is opposed by learned APP for the State.
Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions
