The petitioner has filed the instant application for anticipatory bail apprehending her arrest in connection with Garkha P.S. Case No. 549 of 2018 registered for the offences under Sections 304(B)/34 of the Indian Penal Code. As per the FIR, the sister of the informant was married on 10.03.2018 to one Lokesh Kumar Singh, the younger brother of this petitioner. There is allegation of demand of dowry and torture etc., and the sister of the deceased died on 23.12.2018. It is submitted by learned counsel for the petitioner that so far as the petitioner is concerned, she is the married elder sister of the husband of the deceased. She is a teacher in government

Patna High Court CR. MISC. No.34938 of 2019(2) dt.30-05-2019 2/2 middle school and has been living with her family including one daughter and a son in her sasural.

The application for bail has been opposed by the learned APP for the State.

Having heard the learned counsel for the parties and taking into consideration that the petitioner happens to be the married sister -in- law of the deceased, I am inclined to enlarge the petitioner on bail. Let the petitioner namely, Nisha Singh @ Nisha Kumari surrender in the Court below within six weeks from today. In case of her arrest or surrender, the petitioner is directed to be enlarged on bail on furnishing bail bond of Rs 10,000.- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, 14th, Saran at Chapra in connection Garkha P.S. Case No. 549 of 2018 with subject to the conditions as laid down in Section 438 (2) of Criminal Procedure Code. (Partha Sarthy, J) Prakash/- U
