After being confidentially informed regarding assemblage of members of Maoist, an outfit, police party came in action and during course thereof, three motorcycle borne people were apprehended on suspicious activity who disclosed their identity as Kailash Thakur @ Prakash @ Netaji, Vikash Rai @ Vikash Patel @ Shivendu Kumar @ Shivendra Kumar (petitioner) and Baldeo Sah and on search from the possession of Kailash Thakur @ Prakash @ Netaji and country made loaded pistol along with other items as per seizure list, from the possession of Baldeo Sah, two pieces of detonator and from the possession of petitioner, pamphlets were seized. Furthermore, on interrogation, Kailash Thakur @ Prakash @ Netaji made inculpatory extra-

Patna High Court Cr.Misc. No.58463 of 2015 (2) dt.08-02-2016 judicial confessional statement whereupon house of Laxmi Sah was raided and from Bhuskar, cane-bomb was seized. Save and except recovery of pamphlets from the possession of petitioner, nothing has been alleged against him.

Petitioner happens to be under custody since 26.09.2015.

Accordingly, petitioner, Vikash Rai @ Vikash Patel @ Shivendu Kumar @ Shivendra Kumar is directed to be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Sri R.K. Ravidas, Additional Chief Judicial Magistrate, Sitamarhi in connection with Majorganj PS Case No. 248/2015, GR No. 3468/2015. (Aditya Kumar Trivedi, J) perwez U T
