1. Heard learned Senior counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 406, 420, 416, 467, 468 and 471 of the Indian Penal Code.
3. Learned Senior counsel for the petitioner submits that the petitioner is a person with clean antecedent.
4. The informant alleges that one Vimal impersonated him and executed sale deed of his land measuring 2 acres 32 decimal for Rs. 14 lacs which was purchased by the petitioner, when the value of the property is more than a Crore.
5. Learned Senior counsel for the petitioner submits
Patna High Court CR. MISC. No.40736 of 2023(2) dt.03-08-2023 2/3 that the petitioner has been falsely implicated in the present case, it is next submitted that petitioner is a Professor in N.I.T., Patna and Vimal has not been made an accused by the informant, it is next submitted that one Ashutosh Singh has filed a Title Suit No. 200 of 2022 in which the petitioner along with the informant are impleaded as defendant as Ashutosh has pleaded that the land belongs to his maternal grandmother Parwasini Devi who had gifted the land in question to his mother Geeta Devi in the year 1971 and thus prayed that the sale deed executed by Vimal in favour of the petitioner be declared void. It is, thus, submitted that already a title suit is pending between the parties.
6. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
7. Considering the submissions made by the learned Senior counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the
Patna High Court CR. MISC. No.40736 of 2023(2) dt.03-08-2023 3/3 learned trial court where the case is pending/successor court in connection with Singhiya P.S. Case No. 76 of 2022 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
