JUSTICE MADHURESH PRASAD ORAL JUDGMENT Date: 05-12-2017 Heard counsels for the petitioner and the State. The petitioner had earlier approached this Court for the same relief as prayed in the instant writ petition. Vide order dated 25.06.2010 passed in C.W.J.C. No. 689 of 2004, the said writ petition was dismissed as not pressed.

In view of the fact that the counsel for the petitioner had informed the Court in the said writ application that he has already got the relief prayed for, this duplicate proceeding has been initiated contending that actually the petitioner has not got relief and the said

Patna High Court CWJC No.11147 of 2014 dt.05-12-2017 2/2 order has been passed on the basis of some misconception. Be that as it may since the writ petition has been dismissed on the earlier occasion without any liberty to the petitioner, duplication of the writ proceeding for the same relief by the same petitioner, in the opinion of this Court is not maintainable. However, It would be open to the petitioner to avail other remedy available to him in accordance with law.

The writ petition is dismissed.
