The petitioner seeks bail in Buxar Town P.S. Case No. 253 of 2018, registered for the offence punishable under Sections 324, 307/34 of the Indian Penal Code and section 27 of the Arms Act.
As per the prosecution case, this petitioner took loan of Rs. 5,10,000/- from the informant out of which he returned cash of Rs. 1,10,000/- and issued cheque of Rs. 4,00,000/- for which he called the informant to issue another cheque. On being enquired by the husband of informant, petitioner opened fire from his country made pistol causing firearm injury on his neck. It is submitted on behalf of the petitioner that petitioner has falsely been implicated in this case. No such occurrence has ever taken place. Scuffle took place between the
Patna High Court CR. MISC. No.46750 of 2021(3) dt.07-01-2022 2/2 parties over the dishonour of cheque. The doctor has found the injury to be simple in nature. Petitioner is in custody since 23.06.2021. Chargesheet has already been submitted. Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Buxar in connection with Buxar Town P.S. Case No. 253 of 2018.
