====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 03-07-2024 Heard Mr. Rajive Ranjan Singh, learned counsel appearing on behalf of the petitioner and Mr. Satyendra Narayan Singh, learned APP for the State.
2. The petitioner seeks pre-arrest bail in connection with Industrial Area P.S. Case No. 191 of 2022 registered for the offence punishable under Sections 341, 324 and 307/34 of the Indian Penal Code.
3. As per the allegation made in the F.I.R., the petitioner along with other co-accused had assaulted the informant by means of knife and managed to flee away.
4. Learned counsel appearing on behalf of the petitioner submitted that the injury sustained by the informant is simple in nature and no specific allegation has been made against the petitioner that it is the petitioner who had stabbed the informant on the vital part of the body including head.

Considering the past criminal history of the petitioner, I find it proper that if the petitioner files an affidavit giving undertaking that he will not indulge in crime in future, the petitioner, above named, be released on pre-arrest bail, in the event of his arrest or surrender before the Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Bhagalpur in connection with Industrial Area P.S. Case No. 191 of 2022, subject to the condition as laid down under Section 438(2) of the Cr.P.C and further condition that one of the bailors shall be the Mukhiya of the Gram Panchayat to which the petitioner belongs.
6. The bail application stands disposed of.
