19-01-2016 Heard Sri Satya Prakash Parasar, learned counsel for the petitioner and Sri Madan Kumar, learned Addl. Public Prosecutor.
The petitioner, who is in custody in Sono (Charkapathar) P.S. Case no. 137 of 2015 registered for the offence under sections 25(1-b)A, 26 and 35 of the Arms Act, 1959, has prayed for grant of bail.
It was submitted by learned counsel for the petitioner that on an allegation of recovery of one country-made pistol and country-made rifle from the premises of the petitioner, the petitioner and his two brothers have been made accused. The petitioner is having clean antecedent, which fact has been stated in paragraph - 3 of the petition. He further submits that prior to filing
Patna High Court Cr.Misc. No.57655 of 2015 (2) dt.19-01-2016 2/2 of the present petition, other two brothers of the petitioner, who were also made accused in this case, have already been granted bail.
In view of the fact that the petitioner is in custody since 26-08-2015, which has been mentioned in paragraph - 12 of the petition as well as clean antecedent of the petitioner and nature of accusation, let the petitioner namely Umesh Rajak be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Jamui/concerned court in Sono (Charkapathar) P.S.
