The petitioner has filed the instant writ application for a direction to the respondents to consider the case of the petitioner for compassionate appointment on the ground that the father of the petitioner has died on 6.12.2011 in harness. Counsel for the petitioner with reference to various annexures submits that the petitioner and her mother (widow of the deceased employee) have approached the respondentauthorities and they are simply taking time. They have not taken any final decision for appointment of the petitioner on compassionate ground.
Considering the fact that the respondents have to take
Patna High Court CWJC No.825 of 2017(2) dt.01-12-2017 2/2 decision one way or the other on the request of the petitioner for compassionate appointment, they cannot keep the matter pending for years together. The father of the petitioner died on 6.12.2011 and from the documents enclosed to the writ petition it appears that the petitioner and her mother have approached the respondent-authorities for redressal of their grievances for consideration of her case for compassionate appointment but their request has not yielded any result and under the compelling circumstance, the petitioner has filed the instant writ petition. After hearing learned counsel appearing on behalf of the State, the writ petition is disposed of with a direction to the respondent Nos. 4 and 5 to take step on the claim of the petitioner for compassionate appointment. They are accordingly directed to take steps to ensure final disposal of the claim of the petitioner for compassionate appointment within a period of sixty days from the date of receipt/production of a copy of this order.
