2. The petitioner seeks bail in a case registered for the offence punishable under Sections 303 (2) and 317(2) of the Bharatiya Nyaya Sanhita.
3. While the police was on patrolling duty, after seeing the police party, the petitioner was trying to flee away and various stolen articles were recovered from his motorized cart.
4. It is submitted by learned counsel for the petitioner that the petitioner is a dealer of scrap and he deals with exchanging of scrap materials with utensil which is alleged to have been found on the cart. There is violation of mandatory provisions of search and seizure as there is no independent
Patna High Court CR. MISC. No.35830 of 2026(2) dt.08-06-2026 2/2 witness to the seizure. There is one case against him in which he has been acquitted. The petitioner has has been languishing in custody since 27.03.2026.
5. Learned APP for the State opposed the bail petition.
6. Taking into consideration the facts and circumstances of the case and also considering the fact that there is violation of mandatory provisions of search and seizure and as of now there is no criminal antecedent of the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Chanan P.S.
