2. The petitioner seeks bail in Phulwari Sharif P.S. Case No. 2061 of 2025 registered for the offences under Sections 103(1), 238, 61(2) and 3(5) of the BNS, 2023.

3. The allegation is that the informant received information that his daughter had been admitted to Paras Hospital. On receiving the information, he went there and received the dead body of his daughter.

4. Learned counsel for the petitioner submits that the petitioner is the friend of the husband of the deceased. In Paragraph 78 of the case diary, the witness, namely, Aphsana Praveen, who is the owner of the house, has been examined and

Patna High Court CR. MISC. No.36222 of 2026(3) dt.08-07-2026 2/3 she has stated that when they reached, they saw that Ruby Praveen (deceased) was hanging from the ceiling and Md. Rizwi Hasan was trying to remove the rope and bring her down. The FSL report indicates that there is an oblique injury on the neck which suggests that the death was suicidal and not homicidal. He further submits that the petitioner has been in custody since 23.12.2025 and has no criminal antecedents.

5. Learned Additional Public Prosecutor for the State has vehemently opposed the petitioner's prayer for bail.

6. Considering the aforesaid facts and circumstances of the case, particularly the FSL report suggesting that the death was suicidal and not homicidal, and further considering that the petitioner has been in custody since 23.12.2025 and has no criminal antecedents, this Court is inclined to grant bail to the petitioner.

7. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-IV, Patna in connection with Phulwari Sharif P.S. Case No. 2061 of 2025.

8. It is made clear that any observation made herein is prima facie in nature and limited solely for the purpose of
