The petitioner, apprehending his arrest in connection with Louriya P. S. Case No. 166 of 2013 registered for the offences punishable under Sections 420, 469, 468, 471, 482 and 411 of the Indian Penal Code, seeks the privilege of pre-arrest bail. Allegedly, two buses with same number were found plying and, accordingly, on enquiry, it was found that in the name of Anand Travels, both the buses are being run. Submission is that from Annexure-2, it is evident that the petitioner being the owner of Anand Travels have got no concern with the two vehicles, which were plying with same
Patna High Court Cr.Misc. No.28830 of 2014 (4) dt.08-01-2015 registration number and as such, the petitioner, who has been falsely implicated deserves sympathetic consideration to which the learned A.P.P. does not oppose.
In the facts and circumstances stated above, considering Annexure 2, which is letter no. 157 dated 17.06.2014 of the District Transport Officer, West Champaran, Bettiah addressed to the Judge-in-Charge, Civil Court, Bettiah, West Champaran, the petitioner, Santosh Kumar Rai in case of his arrest or surrender within two months shall be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., East Champaran at Bettiah in connection with Lauriya P.S. Case No. 166/13, subject to the conditions as laid down under Section 438(2) Cr. P.C.
