Petitioner is apprehending her arrest in connection with Special Case No.3538 of 2019 , registered for offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act.

As per FIR there is recovery of huge quantity of the liquor from the truck, pulsar motorcycle and scooty. Petitioner is not named in the FIR . The Scooty belongs to the petitioner. Submission of the learned counsel for the petitioner is that FIR does not disclose that he was present there and there is also no recovery so far from the scooty is concerned. Heard learned A.P.P. also.

Having heard both sides and in view of the facts and

No.34921 of 2019(4) dt.07-11-2019 2/2 circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the learned court below, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the6 like amount each to the satisfaction of the learned Special Judge Excise, Patna in connection with Special Case No.3538 of 2019 arising out of Shahpur P.S.Case No.123 of 2019, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
