Learned counsel for the petitioner is directed to remove the defect(s), as pointed out by the office, within a period of four weeks.
The petitioner seeks bail in a case registered under Section-30(a) of Bihar Prohibition of Excise Act, 2018. Earlier the petitioner was granted bail vide Annexure1 to the present application, by order dated 14-12-2017 passed in Cr. Misc. No. 53924 of 2017.
It is submitted on behalf of the petitioner that due to Covid-19 pandemic and lockdown, the petitioner could not appear in the court on 18-04-2020 & 06-04-2021 and in consequence thereof, on 09-04-2021, the bail bond of the petitioner was cancelled. Subsequently, he was remanded in the
Patna High Court CR. MISC. No.38221 of 2022(2) dt.03-08-2022 2/2 present case on 12-04-2022. He has remained in custody for approximately four months. The petitioner had no intention to disobey the orders of the court but due to Covid-19 and lockdown, he could not appear in the court.
Considering the aforesaid facts and circumstances of the case, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Court No. 2, Supaul in connection with Raghopur P.S. Case No. 71 of 2017.
