JUSTICE ASHUTOSH KUMAR ORAL ORDER (Per: HONOURABLE THE CHIEF JUSTICE) 14-09-2018 A grievance, which is voiced in the present application, is non-compliance of the order passed by the learned Single Judge in CWJC No.12210 of 2011 affirmed by the Division Bench in LPA No.328 of 2016.
In reply to the show cause, it is stated that the amount
Patna High Court MJC No.2287 of 2018(3) dt.14-09-2018 2/2 due and payable as per the order passed by this Court in CWJC No.12210 of 2011 has been calculated and the order is already passed on 20th July, 2018.
Learned counsel appearing on behalf of the respondents stated at the Bar that actual payment pursuant to the order dated 20th July, 2018 shall be made to the original writ petitioner within a period of 10 days from today. Now, so far as non-payment of the statutory interest for the delayed payment is concerned, learned counsel appearing on behalf of the State authorities stated at the Bar that the same shall be calculated within a period of two weeks from today and the actual payment, if any, due and payable under the said heading shall be paid to the petitioner within a period of four weeks thereafter. Concerned respondent is directed to act accordingly.
In view of the above, we dispose of the present petition. Any non-compliance of the order shall be viewed very seriously.
