This is an application seeking modification in the order dated 01.07.2021 passed in Cr. Misc. No. 796 of 2021, whereby the petitioner has been granted the privilege of anticipatory bail in connection with Marhowrah P.S. Case No. 829 of 2020 on certain terms and conditions. It has been submitted on behalf of the petitioner that under some unavoidable circumstances, he could not surrender before the Court below within the stipulated period. It has further been submitted that because of the

Patna High Court CR. MISC. No.47788 of 2021(2) dt.25-08-2021 2/2 wrong name of the district provided in the prayer portion, such mistake has also crept in the order dated 01.07.2021. Considering the submission afore-stated, let the name of the district in the satisfaction portion of the order dated 01.07.2021 be read as 'Saran' in place of 'Siwan'. Further, the petitioner/Prakash Nut shall be released on anticipatory bail in the event of his arrest or surrender before the Court below, i.e., learned 2nd Addl. Sessions Judge-Cum-Special Judge, Excise, Chapra, DistrictSaran, within a further period of six weeks from today on the same terms and conditions as laid down in the order dated 01.07.2021.

The order dated 01.07.2021 stands modified to the extent indicated above.

The application stands allowed.
