2. The petitioner makes a prayer for grant of regular bail in a registered for the offences punishable under Sections 30(a), 41 of the Bihar Prohibition & Excise Act.
3. The FIR and seizure list would go to show that total 819 liters of foreign liquor has been recovered from behind the bushes and the accused person fled away from the place of occurrence.
4. Learned counsel for the petitioner submits that the name of the petitioner has surfaced in this case on the basis of disclosure by the local Chaukidar. There is no recovery from the physical and conscious possession of the petitioner rather

It has also been submitted that the petitioner had moved for anticipatory bail before the Hon'ble Court but the same was rejected only on the ground of his criminal antecedents. Further the learned counsel has invited the attention of this Court to orders dated 01.10.2024,03.10.2024 and14.02.205 passed in Cr. Misc. No.65153 of 2024, in Cr. Misc. No. 67947 of 2024 and Cr. Misc. No. 76349 of 2024 vide order dated 03.10.2024 and Rajiv Kumar in Cr. Misc. No.76349 of 2024 respectively whereby co-accused Ajit Kumar, Md. Sonu@ Md. Sakil and Rajiv Kumar have already been granted bail by a co-ordinate Bench of this Court. The petitioner is in custody since 16.04.2025 and an accused in one other case for which he has already been granted anticipatory bail.
5. The learned APP opposes the prayer for bail .

Considering the aforesaid facts and circumstances of the case, let the above named petitioner shall be enlarged on bail on furnishing bail bonds of Rs 10,000/- (ten thousand)with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/ successor court in Musrigharari P.S. Case No.102 of 2024.

7. The petitioner is directed to appear before the investigating officer of the concerned police station on each and every date fixed by the trial court till the charge sheet is submitted. In case of default in appearance on two consecutive dates, without giving any reasonable cause, the trial court will have liberty to cancel the bail bonds of the petitioner.
