This is an application for anticipatory bail for the offence punishable under sections 419, 420, 504 and 506 of the I.P.C.
Allegedly, the petitioner thorough his mobile phone asked the informant, a junior Engineer, as to how the bill of Binod Kumar Singh has been reduced from 22,00,000/- and odd to Rs. 18,00,000/- and odd and started abusing filthy language and thereafter reached at his house and again raised filthy language and threatened him with dire consequences if Rs. 4,00,000/- is not given to the petitioner. It is alleged that the petitioner has committed offence only with a view to take commission from Binod Kumar Singh and he is indulged in such behavior.
Patna High Court Cr.Misc. No.27984 of 2014 (5) dt.19-01-2015 2/2 Submission is that in fact no offence under section 419 I.P.C. or any of the sections is made out. The petitioner has no concern with any way. The informant himself prepared the bill only to put pressure upon him with a view to take commission from Binod Kumar Singh and Binod Kumar Singh has filed a petition that the petitioner has not demanded any commission from him. The petitioner is a registered Grade-II contractor and he pays the income-tax to the Government in lacs per annum. The learned A.P.P. opposes prayer for bail.
Considering the submissions urged at the bar, going through the records and noticing that nothing has been paid and as Binod Kumar Singh is stating that the petitioner has not demanded any commission and as such the petitioner, in case of his arrest or surrender within two months from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M. Saran at Chapra in Chapra Town P.S. Case No. 38 of 2014, subject to the conditions as laid down in section 438 (2) Cr.P.C.
