The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 376 of the Indian Penal Code and 3/4 of the Dowry Prohibition Act.
The prosecution case is that the informant was initially married with Guddu Paswan and gave birth to a male child, but two years prior to the lodging of the case, the husband of the informant died. It is further alleged that after the death of the husband of the informant, her cousin brother-in-law Ramod Paswan developed sexual relationship on promise to marry, but subsequently demanded rupees one lakh for performing marriage. Patna High Court Cr.Misc. No.8715 of 2016 (2) dt.24-02-2016 brother of Ramod Paswan assured the informant that the marriage will be performed.
Considering the thrust of accusation against Ramod paswan and coupled with the statement made in para-3 of the petition that petitioner has no criminal antecedent, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga in connection with Jalley P.S. Case No. 80 of 2014, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
