This application is filed for grant of regular bail in connection with G.R. No. 122/2023 arising out of Khutauna P.S. Case No. 26 of 2023 registered under section 272, 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2018.

Learned counsel for the petitioner submits that there is recovery of 115 litre foreign liquor. the petitioner is in custody since 02.03.2023. The petitioner is accused in one more case but it is not of Excise Act.

Learned A.P.P. has vehemently opposed the prayer for

Patna High Court CR. MISC. No.41635 of 2023(3) dt.19-07-2023 2/2 bail.

Considering the period of custody, this application for regular bail is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Judge, Jhanjharpur District Madhubani in connection with G.R. No. 122/2023 arising out of Khutauna P.S. Case No. 26 of 2023.
