JUSTICE SUDHIR SINGH ORAL ORDER 18-04-2016 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case instituted under Sections 406, 420, 379, 342, 323 and 34 of the Indian Penal Code.

Allegation against the petitioners is that petitioner no. 1 took Rs. 35,000/- from the informant and handed over her a forged appointment letter. When demand was made for returning the money, informant was assaulted by both the petitioners and petitioner no. 2 tried to misbehave with her. It is submitted on behalf of the petitioners that they have falsely been implicated in the present case. There is no substantive evidence to show their implication in the present case. From perusal of Annexure-2 it is evident that the matter has been compromised between the parties.

On behalf of the State, it is submitted that petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of arrest or surrender in the

Patna High Court Cr.Misc. No.10919 of 2016 (2) dt.18-04-2016 2/2 court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Masaurhi, in connection with Masaurhi P.S. Case no. 223 of 2014 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
