According to the first information report itself, informant had not seen the actual killing of the deceased and she only claims to this extent that she had seen the petitioner and others coming out from her house. Furthermore, informant claims that prior to alleged occurrence, a quarrel had taken place and in the said quarrel, mother of the informant sustained injury and subsequently, petitioner and other FIR named accused had given threat to the informant as well as her father.

Investigation against the petitioner has already been completed.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on

Patna High Court Cr.Misc. No.3175 of 2016 (3) dt.24-02-2016 furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saharsa in Saharsa P.S. Case no. 786/2015.
