JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 18-11-2021 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 304B/34 of the Indian Penal Code.

As per the prosecution case,this petitioner along with other accused persons committed torture causing death of sister of informant in connection with dowry.

Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. Petitioner is Gotani of deceased and there is general and omnibus allegation against her. Petitioner is living separately and she has different mess and establishment and she has no occasion to demand dowry since marriage was solemnized on 01.03.2017. Petitioner claims clean antecedent and is in custody

Patna High Court CR. MISC. No.47369 of 2021(2) dt.18-11-2021 2/2 since 04.04.2021 and investigation in this case is complete. Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in connection with Hajipur Industrial Area PS case No. 70/2021.
