JUSTICE DINESH KUMAR SINGH ORAL ORDER 01-03-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 143,341,223,225,353,504 and 506 of the Indian Penal Code. The prosecution case is that the police officials went to arrest accused persons in connection with Dhoraiya (Dhankund) P.S. Case No. 51 of 2015 and arrested one Binay Harizan when the petitioner and others got Binay Harizan released and dashed the informant and thereby obstructed informant and others in discharge of official duty.
It is submitted by the learned counsel for the petitioner that the petitioner is not related to Binay Harizan and the accusation is omnibus and general against several persons. Statement has been made in paragraph 3 of the petition that the
Patna High Court Cr.Misc. No.9386 of 2016 (2) dt.01-03-2016 2/2 petitioner has no criminal antecedent. More over, similarly situated co accused Dablu Singh has been granted anticipatory bail vide Cr. Misc. No. 44259 of 2015.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Banka, in connection with Dhoraiya (Dhankund) P.S. Case No. 116 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
