Learned counsel for Respondent no. 7 submits that they had recommended for payment of amount to the petitioner under the heading of Gratuity, Group Insurance and arrears of Earned Leave and sought guidelines for payment of G.P.F. and pension from the Accountant General of Bihar.

So far the claim of GPF is concerned, the contribution is deducted from the salary of the petitioner and deposited to his account, as such, the petitioner cannot be deprived of the same. Accordingly, this Court directs the Respondent authority to make payment the amount of GPF to the petitioner without any delay and at the same time, as the petitioner is facing criminal case, in terms of section 43 (d), 90% pension amount ought to be paid to him, if already not paid. With the above observation and direction this petition is disposed of.
