The petitioner is facing a criminal case vide Nawada P.S. Case No. 29 of 2012 for the offence under Sections 343, 323, 302, 201/34 of the Indian Penal Code, making allegation that the victim had died in the Police custody. A departmental proceeding was initiated against the petitioner, but at his behest the departmental proceeding has been stayed till the disposal of the criminal case.

Patna High Court CWJC No.13688 of 2018(3) dt.17-12-2018 2/2 In this writ petition, the petitioner is challenging the order of suspension, he cannot be allowed to play hot and cold at the same time.

In such view of the matter, this Court does not find any merit in this writ petition, accordingly, the same is dismissed.
