JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 22-01-2021 Heard learned senior counsel for the petitioner and learned counsel appearing on behalf of the State. The petitioner is in custody in connection with Magadh University P.S. Case No. 11 of 2020, for the offence under Section 392 of the Indian Penal Code.

Mr. Krishna Prasad Singh, learned senior counsel for the petitioner submits that the petitioner has no criminal antecedent. The first information report was lodged against four unknown persons for loot of pick-up van loaded with 6 quintals 40 Kg. fish. Petitioner is in custody since 17.02.2020. Considering the fact that the petitioner has no criminal antecedent and he is in custody since 17.02.2020, the Court is inclined to grant bail to the petitioner subject to the condition

Patna High Court CR. MISC. No.35931 of 2020(2) dt.22-01-2021 2/2 that the petitioner has to deposit Rs.25,000/- in cash. On depositing the amount of Rs.25,000/-, petitioner, above-named, shall be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-IX, Gaya in connection with Magadh University P.S. Case No. 11 of 2020.

Deposit of Rs.25,000/- (Rupees twenty five thousand) shall abide by final outcome of Magadh University P.S. Case No. 11 of 2020.
