Petitioner is accused in connection with Kalyanpur P.S. Case No. 255 of 2015 registered under Sections 436/34 of the I.P.C. and 3 (i) (x) 3 (2) (v) S.C/ST (prevention of atrocities) Act. The allegation of informant, Ramita Devi, is that in the evening of 06.09.2015, three persons set fire in her house after sprinkling the kerosene oil in which cash Rs. 2000/-, ornament and house hold articles were burnt to ashes. She identified the petitioners and Awadhesh Singh at that time. Cause of occurrence is that the accused wants to get the land vacated. Learned counsel appearing on behalf of the
Patna High Court Cr.Misc. No.56243 of 2015 (2) dt.15-12-2015 petitioner submits that petitioner is a student of B.A. and has falsely been implicated in this case due to filing of case under section 107 of the Cr. P.C. against the informant and others. Earlier father of the petitioner, Rambabu Singh had lodged Kalyanpur P.S. Case No. 215 of 2015 against the witnesses, Sonalal Das and others of the present case for the offence under sections 447, 341, 342, 323, 504, 379/34 of the I.P.C. also. It is also submitted that petitioner is in custody since 07.09.2015. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, Motihari in connection with Kalyanpur P.S. Case No. 255 of 2015.
