JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 25-01-2021 As prayed for, let the learned counsel for the petitioner remove the defect(s), as point out by the office vide it's note, dated 09.12.2020, within four weeks from today. Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the state.
The petitioners seek bail in connection with Balia P.S. Case No. 476 of 2019, registered under Sections 461 and 379 of the Indian Penal Code.
The accusation is of theft of cash of Rs.14,812/- and lap-top set on breaking shop of the informant in name of M/s Mamta Auto Agency by unknown thief.
Submission is that it would appear from the first information report that on the basis of fardbeyan of informant, Shahid Parvez, Balia P.S. Case No. 476 of 2019 was instituted on 27.12.2019 for the offence under Sections 461 and 379 of the
Patna High Court CR. MISC. No.33779 of 2020(3) dt.25-01-2021 2/2 Indian Penal Code against unknown. After lodging the present case, petitioner was apprehended by the police in suspicious condition with lap-top bag, containing some instruments of breaking the lock and lap-top and Khagaria P.S. Case No. 58 of 2020 was instituted under Sections 454, 511, 414 and 379 of the Indian Penal Code on 22.01.2020. Thereafter, petitioner was remanded in this case on 21.03.2020. Further, submission is that in fact petitioner is accused in seven cases, including Khagaria P.S. Case No. 58 of 2020, due to that reason police implicated the petitioner in present case with false allegation. Having regard to the facts and circumstances of the case, let the petitioners, above named be released on bail on furnishing bail bonds of Rs.
10,000/- (rupees ten thousand) each with two sureties of the like amount each in connection with Balia P.S. Case No. 476 of 2019 to the satisfaction of Sri Sunil Kumar, Judicial Magistrate, 1st Class, Begusarai, subject to the condition that out of the two sureties, one must be either parents or the close relative of the petitioner.
