JUSTICE SUDHIR SINGH) 25-09-2025 The present contempt application has been filed for initiation of contempt proceedings against the contemnor opposite party for willful disobedience of order dated 22.02.2022 in CWJC No.21424 of 2021 passed by a Co-ordinate Bench of this Court, in which the following directions were made:
"Be that as it may, we direct the Appellate Authority to dispose of the appeal preferred by the petitioner positively within a period of 60 days from the date of receipt/production of a copy of this order before him, failing which, an adverse view shall be taken against the concerned respondent."
2. A show-cause has been filed on behalf of O.P. No.3.
Patna High Court MJC No.1154 of 2022(2) dt.25-09-2025 2/3 The following statements have been made in paragraph no.8 of the show-cause:
"That the statement made in Para No. 8 & 9 of the MJC Petition, denied. It is humbly stated that the petitioner has filed a petition alongwith the copy of the aforesaid order of CWJC No.21424/2021 before the Answering Opposite on 13.06.2022. The Appeal was admitted and Lower Court Record from SDO (west) Muzaffarpur was called for on 17.06.2022. The L.C.R. was received on 23.08.2022 but the Answering Opposite Party was busy in other works so the court was adjourned and next date on 20.09.2022 was fixed and after hearing both the parties on 20.09.2022 a direction was issued to the Petitioner (Appellant) to file distribution register and the details of e-Poss Machine and the next date was fixed on 11.10.2022 but the petitioner has failed to comply the direction of the court on the next dates i.e. 11.10.2022 and 22.11.2022.
Hence on the basis of the materials available on the record and hearing of the Appellant and the State of Bihar, the Answering Opposite Party has passed order on 22.11.2022 for dismissal of the Appeal, it is evidently clear that in spite of the instructions of Licensing Authority vide his memo No. 133 dated 06.05.2021, 740 dated 02.08.2021, the petitioner has failed to submit relevant evidence in support of denial of the charges leveled against him before Licensing Authority and again intentionally and deliberately disobeyed the direction of the Appellate Authority dated 20.09.

3. Considering the statements made in the paragraph referred above, we are of the considered opinion that no further order is required to be passed in the present case.
4. Accordingly, the present application stands disposed of.
