Informant, brother of alleged victim Puja Kumari, aged about 15 years had alleged that on 11.09.2015 at about 07:00 A.M. his sister had gone to offer Pooja and thereafter is missing. On query he came to know that Ankit, Deepak enticed her away. The aforesaid written report was filed on 14.09.2015. Furthermore, taking into account the statement of the victim (Annexure-2) coupled with the period of detention of the petitioner since 20.10.2015, petitioner Ankit Sah is directed to be released on bail on furnishing bail bonds of Rs.10,000/-(ten thousand) with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in

Patna High Court Cr.Misc. No.58498 of 2015 (2) dt.05-02-2016 connection with Mojahidpur (Babarganj) P.S. Case No.179 of 2015, subject to condition that petitioner's presence should not be in or around the victim as well as will not coerce, threat, allure her till her examination failing which, the privilege so granted to the petitioner will automatically cease.
