JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-01-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner was made accused in this case on the basis of suspicion as there was previous dispute between the petitioner and the deceased and allegedly, prior to alleged occurrence, petitioner and other F.I.R. named accused had given threatening of dire consequences to the deceased.

It would appear from perusal of the impugned order that in course of investigation, witnesses stated the above stated fact and except the aforesaid material, there appears to be nothing against the petitioner. However, learned counsel appearing for the informant points out that when the statement of wife of deceased was recorded in course of investigation, she disclosed that

Patna High Court Cr.Misc. No.1700 of 2016 (2) dt.18-01-2016 2/2 deceased was taken away by the petitioner and other F.I.R. named accused but the aforesaid fact has neither been mentioned in Sanha nor in the first information report which has been lodged by the brother of the deceased.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri A.K. Thakur, J.M. Ist Class, Danapur in connection with Maner P.S. Case No.273 of 2015. (Hemant Kumar Srivastava, J) N.H./- U T
