Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 353, 384, 448, 504, 506 of the Indian Penal Code. The prosecution case is that the petitioner entered into the office of the informant being the Revenue Karamcharicum-Circle Inspector and demanded extortion and in the eventuality of non payment of the extortion amount informant was threatened to face dire consequences.
It is submitted by the learned counsel for the petitioner that since the petitioner used to make protest against the corrupt practices of the Government Officers hence, accusation has been levelled. Even assuming the accusation no offence under Section 384 is made out against the petitioner.
Patna High Court Cr.Misc. No.10495 of 2016 (2) dt.08-03-2016 There is no official Chambers of the Revenue Karamchari-cumCircle Inspector. Considering the fact that even assuming the accusation no offence under Section 384 of the Indian Penal Code is made out against the petitioner, let the learned court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Pusa P.S. Case No. 113 of 2015, pending in the court of learned Additional Chief Judicial Magistrate-VI, Samastipur. With the above observation this application is disposed of.
