Patna High Court Cr.Misc. No.879 of 2017 (4) dt.31-01-2017 2/3 State.

The petitioners seek bail in a case instituted for the offence under Sections 7/8/13(2) read with Section 13(1)(D) of P.C. Act.

It has been submitted on behalf of the petitioners that other co-accused Gulam Mustafa Ansari with similar allegation has already been granted bail by Co-ordinate Bench of this Court vide Cr. Misc. No. 1764 of 2017 dated 19.01.2017. It has further been submitted that from perusal of the running page51 Post Trap Memorandum (internal page-36), it will be apparent that there is no specific allegation against these petitioners of taking the amount of bribe. It is mentioned in the memorandum itself that informant told that money has been given to the bodyguard and bodyguard has given the money to these petitioners. The S.D.O. with similar allegation as mentioned has already been granted bail by Co-ordinate Bench of this Court as mentioned above. These petitioners are in custody since 28.10.2016.

Considering the aforesaid facts and circumstances of the case, let the petitioners above named, be released on bail on furnishing bail bonds of Rs.10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned
