JUSTICE SUDHIR SINGH ORAL ORDER 25-04-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case registered under Sections 33,41, 42 and 63 of the Indian Forest Act, 1927.

The allegation against the petitioner is that he had quarried out stone from an area of the reserved forest. It is submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. The petitioner has been made accused due to mistake of fact. There is no substantive evidence to show the implication of the petitioner in the present case. It is further submitted that the petitioner is ready to deposit an amount of Rs. 10,000/- in the court below, which shall be subject to final disposal of the case.

Patna High Court Cr.Misc. No.11125 of 2016 (2) dt.25-04-2016 2/2 On behalf of the State, it is submitted that the petitioner is named in the FIR.

Considering the aforesaid facts, the petitioner is directed to deposit an amount of Rs. 10,000/- (ten thousand) in the court below, which shall be subject to final disposal of the case. Let the above named petitioner, in the event of his arrest/surrender in the court below within a period of six weeks from today be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate1, Rohtas at Sasaram in Forest Act Case No. 37 of 2011, subject to the conditions as laid down u/s 438(2) Cr.P.C.
