JUSTICE SATYAVRAT VERMA ORAL ORDER 12-01-2022 Heard the learned counsel for the petitioner and the learned APP for the State through video conferencing. The petitioner seeks bail in connection with Gopalpur P. S. Case No.376 of 2020, instituted for the offences under Section 379 of the Indian Penal Code.

The learned counsel for the petitioner submits that the petitioner is in custody since 11.01.2021 and charge-sheet has been submitted in the case.

The learned counsel for the petitioner submits that the informant alleges that driver Ravindra Paswan committed theft of truck laden with Patanjali goods worth Rs. Nine Lakhs which was to be delivered at Aurangabad.

The learned counsel for the petitioner submits that the truck was found abandoned in between Shahbazpur and

Patna High Court CR. MISC. No.46962 of 2021(2) dt.12-01-2022 2/2 Rahmanpur and police spy informed that the goods have been kept by the driver in the house of petitioner and one another friend of his and accordingly, the goods were recovered from the house of petitioner and Binay Paswan.

The learned counsel for the petitioner further submits that petitioner is innocent and has been falsely implicated in the case. He was not aware that the goods kept by Ravindra Paswan were stolen property.

The learned A.P.P. for the State opposes the bail application.

Considering the fact that the petitioner is in custody since 11.01.2021 and charge-sheet has been submitted in the case, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-IX, Patna in connection with Gopalpur P. S. Case No.376 of 2020. The application stands allowed.
