The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 366(A)/34 of the Indian Penal Code.

It is a case of abduction of the daughter of informant by the petitioner and co-accused persons.

It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in the present case. It is also submitted that petitioner is not named in F.I.R and during investigation of this case his name sprang up. It is further submitted that victim has made specific

No.37661 of 2022(2) dt.30-11-2022 2/2 allegation of abduction against co-accused Chandan Giri and she has not whispered about the complicity of the petitioner in her statement recorded u/s 161 Cr.P.C. before the I.O. but after three days her statement has got been recorded u/s 164 Cr.P.C. in which she has given tutored statement before the learned Magistrate and taken the name of the petitioner, which creates doubt in authenticity of the fact. It is also submitted in para 9 of the petition that co-accused Chandan Kumar has been acquitted by the concerned Court. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned A.D.J. VIII, Siwan in connection with G.B. Nagar P.S. Case No. 242 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
