The petitioner seeks bail in connection with Hajipur Sadar P.S. Case No. 325 of 2015 registered for the offences punishable under Sections 364A, 377, 392/34 of the Indian Penal Code.
Allegedly, the informant was kidnapped and ransom of Rs. 2,00,000/- was demanded from the sister of the informant, they snatched Rs. 200/- from his pocket and the petitioner and other three co-accused have committed unnatural sex with him. Submission is of false implication and that in this case similarly situated co-accused Manoj Kumar has been allowed bail
Patna High Court Cr.Misc. No.57995 of 2015 (3) dt.17-02-2016 by another co-ordinate Bench of this Court vide Cr. Misc. No. 41028 of 2015 and was directed to be released after completion of nine months in custody from the date of his remand and as such the petitioner also deserves sympathetic consideration to which learned APP is not in a position to distinguish the case of the petitioner from that of co-accused.
In the facts and circumstances stated above, the petitioner above named is directed to be released on bail after completion of nine months custody from the date of his remand in this case on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali in connection with Sadar P.S. Case No. 325 of 2015, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
