The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 392 of the Indian Penal Code.
The prosecution case is that the informant being S.I. of Police was travelling along with SAP Constable when his motorcycle, cash, mobile phone and other articles were robbed leading to registration of the FIR against four unknown. The name of the petitioner sprang up during investigation on the confession of co-accused Amitabh Kumar.
It is submitted by learned counsel for the petitioner that nothing has been recovered from the petitioner
Patna High Court Cr.Misc. No.9570 of 2016 (2) dt.01-03-2016 2/2 and Amitabh Kumar has been granted regular bail by a coordinate Bench of this Court vide Cr. Misc. No. 4067 of 2016. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Kutumba P.S. Case No. 58 of 2015 pending in the court of learned Chief Judicial Magistrate, Aurangabad.
With the aforesaid observation, this application is disposed of.
