The petitioner seeks bail in connection with Tariyani P.S. Case No. 27 of 2015 registered for the offences punishable under Sections 147, 148, 149, 341, 342, 323, 384, 452, 458, 435, 436, 504 of the Indian Penal Code, 27 of the Arms Act and 17 of the Criminal Law Amendment Act.
It is contended that the petitioner is neither named in the FIR nor any witness has come forward to take his name in course of investigation. His name transpired in course of investigation on the basis of confessional statement of co-accused. It is further contended that several other co-accused having identical allegation have already been granted bail by different
Patna High Court Cr.Misc. No.56121 of 2015 (2) dt.15-12-2015 2/2 orders passed by a coordinate Bench of this Court. Regard being had to the submissions made at the Bar that the petitioner has got no criminal antecedent and without putting him on Test Identification Parade the Police have submitted report under Section 173(2) of the Code of Criminal Procedure,, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sheohar in connection with Tariyani P.S.
