The petitioner apprehends his arrest in connection with Sheikhpura Mahila P.S. Case No.41 of 2013 registered under Sections 323, 341, 354A, 504 and 506/34 of the Indian Penal Code besides Section 3(1)(x)(xi) of the SC/ST Act. The accusation is that the petitioner being the Head Clerk of the Sub Divisional Jail, Sheikhpura, abused the informant Anjali Devi, a lady prisoner, denoting her caste's name on refusing to take the food and making the request to provide the medicine due to stomach pain.
Learned counsel appearing on behalf of the petitioner
Patna High Court Cr.Misc. No.9607 of 2016 (2) dt.11-04-2016 2/2 submits that the petitioner is the Head Clerk of Sub Divisional Jail, Sheikhpura. It is also submitted that while the police on investigation submitted the final form against the petitioner and the co-accused due to lack of evidence but the learned Chief Judicial Magistrate differing with the final form submitted by the police took the cognizance of the offence under the aforesaid Sections against the petitioner and the co-accused. Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sheikhpura, in connection with Sheikhpura Mahila P.S. Case No.41 of 2013, subject to the conditions laid down under Section 438(2) Cr. P.C.
