2. The petitioners apprehends their arrest in connection with Tariyani P.S. Case No. 41 of 2017, registered for the offence punishable under Sections 341, 323, 307, 302, 504/34 of the Indian Penal Code.

As per F.I.R., on 12.03.2017 at about 5:30 PM, the husband of informant was returning home, in the meantime, these petitioners along with other co-accused persons surrounded him near the house of Ramchandra Rai and thereafter, co-accused Umakant Thakur assaulted informant's husband with iron rod and these petitioners & others assaulted

Patna High Court CR. MISC. No.35999 of 2026(3) dt.21-07-2026 2/2 him with Lathi & bamboo, on account of which, husband of informant fell on the ground and became unconscious. Later on, in course of treatment, he died.

4. Learned counsel for the petitioners submits that petitioners are quite innocent and have committed no offence. Allegation of assault is general & omnibus. Police, after investigation, submitted final form. Specific accusation of assault with iron rod is against co-accused Umakant Thakur.

However, learned counsel for the informant vehemently opposes the prayer for anticipatory bail and submits that there is specific & direct allegation against these petitioners and they along with other co-accused brutally assaulted husband of informant with bamboo, Lathi & iron rod, due to which, in course of treatment he died. Informant claims to be eye-witness to the occurrence.

6. In the facts & circumstances of the case and nature of accusation, the prayer for anticipatory bail of petitioners is rejected.
