The petitioners seek bail in a case registered for offences punishable under Sections 302/120B/34 of the Indian Penal Code. It is contended on behalf of the petitioners that they have been named for the reason that, being the relatives of the informant had visited his house and staying there. Allegation is that there was some quarrel between the petitioners and the informant's family. However, the son of the informant was found dead out side the house and the body was recovered besides the transformer. Cause of death is asphyxia but everything in the first information report is based on suspicion as nobody has
Patna High Court Cr.Misc. No.52452 of 2015 (2) dt.15-12-2015 2/2 seen the occurrence and only in view of the fact that there was some verbal quarrel between the petitioners and family of the informant, such allegation has been levelled. It is also contended that the informant has filed petition before the court below that he does not want to contest the case.
Having regards to the facts and circumstances of the case, the petitioner, namely, Ramdhar Choudhary, Ramayan Chaudhary and Guddu Chaudhary are directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bettia, West Champaran in Shikarpur P.S.
