Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Jalalgarh P.S. Case No. 33 of 2021 lodged under Section 302/34 of the Indian Penal Code.

As per prosecution, total 21 known persons and 2-3 unknown persons have been made accused. The allegation against all of them is that they assaulted the husband of the informant and killed him.

Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. He further

Patna High Court CR. MISC. No.37518 of 2022(2) dt.23-09-2022 2/2 submits that there is general and omnibus against 21 named accused persons. He further submits that petitioner is in custody since 10.08.2021 having clean antecedent and charge sheet has already been filed in this case. He further submits that the Coordinate Bench of this Court has pleased to grant bail to the similarly situated 8 accused persons which is Annexure-2 series. Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of the case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with Jalalgarh P.S. Case No. 33 of 2021, subject to the conditions as laid down under Section 437(3) of Cr.P.C.. With this observation, the bail application stands allowed.
