JUSTICE SANJAY PRIYA ORAL ORDER 24-04-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Rajeev Nagar P.S. Case No. 22 of 2017 instituted for the offence under Section-41 of the Bihar Excise (Amendment) Act, 2016.
From the written report, it appears that 14 bottles of Royal Stag each containing 375 ml. were recovered from possession of the petitioner. The petitioner is said to be in custody since 31-01-2017. In paragraph-3, it has been mentioned that petitioner has no criminal antecedent. It has been submitted that co-accused namely, Nishant Kumar has been granted privilege of bail by a coordinate bench of this court by order dated 06-03-2017 passed in Cr. Misc. No. 9987 of 2017.
Accordingly, the prayer for bail is allowed and the
Patna High Court Cr.Misc. No.14773 of 2017 (2) dt.24-04-2017 2/2 petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Rajeev Nagar P.S. Case No. 22 of 2017 to the satisfaction of Sri Abhijeet Kumar, Sub Judge-III-cum-ACJM, Patna subject to condition that both the bailors should be close relatives of the petitioner.
