JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 23-08-2019 Heard learned counsel for the petitioner and the counsel appearing on behalf of the State as well as University. The issue reaised in the writ petition is covered by the decision of this Court in C.W.J.C. No. 13288 of 2014 vide oral judgment dated 04.10.2018.

Similar issue was decided by this Court. The only difference in this case is that the pay verification cell has found the claim of the petitioner justified, as appears from Annexure-7 which is part of the supplementary affidavit filed in the present case.

Patna High Court CWJC No.11300 of 2019(3) dt.23-08-2019 2/2 Considering the aforesaid, the writ petition is disposed of with a direction to the respondents to grant consequential benefits to the petitioner at the earliest preferably within a period of sixty days from the date of receipt/production of a copy of this order.

In the event, available fund of the University is not adequate for payment of dues to the petitioner, the University shall raise demand for allocation of additional fund which shall be considered by the State Government appropriately so that arrears of the petitioner may be paid.
